TERMS AND CONDITIONS OF PARTICIPATION

(hereinafter referred to as "Promotional Campaign")
PLEASE READ THE BELOW TERMS AND CONDITIONS CAREFULLY AND PARTICIPATE IN THE PROMOTIONAL CAMPAIGN ONLY IF YOU AGREE TO THE TERMS AND CONDITIONS SET OUT HEREIN AND ARE OVER THE AGE OF 18 YEARS.

1. The Organiser and Operator of the Promotional Campaign
1.1. "WIN WITH HELL" Competition (hereinafter referred to as the "Promotional Campaign") is organised by HELL-ENERGY PRIVATE LIMITED (hereinafter referred to as the "Organiser" or the "Data Controller").
1.2. The execution and implementation of the Promotional Campaign are managed by the Organiser in collaboration with RewardPort (hereinafter referred to as the "Operator" or "Data Processor").

2. Conditions of Participation
2.1. The Promotional Campaign is open exclusively to Indian citizens over the age of 18 years, residing or domiciled in India, who are not among the persons excluded under Clause 2.5 and who possess the legal capacity to participate (hereinafter referred to as "Participant").
2.1.1. To be eligible, Participants must purchase one (1) of the Participating Products listed in Section 3.2 from any authorized store in India.
2.1.2. Participants must register on the official campaign website www.winwithhell.in by providing their full name, phone number, email ID, date of birth, PIN code, and a valid unique voucher code found inside the pull tab of the Participating Products.
2.1.3. The unique code must be uploaded in the designated section of the Website. Entries with duplicate codes will not be considered valid.
2.1.4. Participants can enter the daily and weekly draws multiple times using the same phone number; however, each entry must be made with a different unique code. The same unique code cannot be used more than once., by uploading he/she accepts all the conditions set out in these Terms and conditions.
2.1.5. The uploaded Code cannot be edited or otherwise modified afterwards.
2.1.6. A Participant is entitled to upload upto 5 Codes per day with one mobile number. A Code Upload is valid, provided that it meets all the requirements of these Terms and conditions.
2.2. Participants must retain the pull tab as proof of purchase, as it may be required for verification while claiming any prize.
2.6. Participants will be identified by the data provided by them during registration and provided to the Organiser during their participation in the Promotional campaign. The Organiser and the Operator acting on its behalf shall not be held liable for any technical problems (in particular, but not limited to, changes in data, etc.) arising from any changes to the data, which are outside the Organiser's control. The Participant shall ensure that the profile is maintained continuously during the duration of the Promotional campaign and until any Prize is awarded and that the Organiser can contact the Participant using the data provided therein in connection with the provisions of these Terms and conditions. The Organiser and the Operator exclude all liability for any disputes arising from the termination of the Profile or from the provision of insufficient data for contacting.
2.7. The Organiser shall automatically exclude from the Promotional campaign any Participant who participates with false data.
2.8. The Organiser will only consider valid those Code uploads that are submitted by the Participants by providing their own data and are submitted by uploading an original Code, free from external interference, which appears on the can opening tab of the Participating Product. If the Participant does not use the Profile created for the purpose of this Promotional campaign or the data uploaded is not original, free from external interference and not based on the Code displayed on the can opening tab of the purchased Participating Product, the Organiser and the Operator exclude all liability in relation to disputes arising from the accuracy of the data provided and the authenticity of the Code uploaded during the Promotional campaign.
2.9. By uploading the Code, the Participant acknowledges that the content, performance, message and data transmission and response speed of the technical infrastructure of the Promotional campaign are dependent on the server technology and may be adversely affected by factors beyond the control of the Organiser and the Operator, such as (but not limited to) connection failure, server computer performance, network congestion, network load, coverage, the operation of the Website and the maintenance of a secure network connection. The Organiser and the Operator exclude all liability arising from this paragraph.
2.10. Code uploads may be examined by the Organiser for compliance with the terms and conditions of the Terms and conditions, and if they or the Participants submitting them do not comply with the terms and conditions of the Terms and conditions for any reason, the Participant concerned may be disqualified from the Promotional campaign.
2.11. Participants who, contrary to the spirit of the Promotional campaign, participate in the Promotional campaign under the name or telephone number of a natural person in a team or with several Profiles at the same time, with the aim of increasing their chances of winning by such deceptive conduct, may be excluded from the Promotional campaign at the sole and unbiased discretion of the Organizer. Such Participants include, for example, persons associated for the purpose of participating in sweepstakes and other prize draws who, in order to win prizes or the grand prize, coordinate their actions and combine the performances of several persons under one name, thereby depriving other Participants who wish to play fairly of the chance of winning. Such persons shall also be deemed to be those who participate in the Promotional campaign with false information or with several Profiles at the same time, with the aim of unfairly increasing their chances of winning. Participants who engage in the unfair conduct set out in this clause shall be liable to compensate the Organiser and/or the Operator for any damage caused to them in connection with the Promotional campaign.
2.12. If a participant over the age of 18 has limited legal capacity, they may claim the prizes listed in Sections 4.2 and 4.3 of these Terms and Conditions only in the presence of their legal representative, upon providing proof of the representative’s identity.
2.13. If the participant is an incapacitated person over the age of 18, their legal representative may act on their behalf upon providing proof of identity.
2.3. Employees of the Organiser, Operator, affiliated companies, and their immediate family members are not eligible to participate.

3. Promotional Campaign Duration and Participating Products
3.1. The Promotional Campaign will run from 7th April 2025 (00:00 IST) to 31st May 2025 (23:59 IST).
3.2. The following products, featuring the Michele Morrone Limited Edition packaging, are part of the campaign:
- HELL Classic 250ml
- HELL Watermelon 250ml
- HELL Apple 250ml
The Organiser is entitled to expand the range of Participating Products in the Promotional campaign, about which the Participants will be notified in accordance with these Terms and conditions.

4. Prizes and Rewards
Tasks of the Participants:
The Participant shall purchase one (1) of the Participating Products, and shall keep the can opening tab (the "Tab") for six (6) months following the purchase. Only those Tabs can be accepted, on which the Code is properly readable. The Organiser and the Operator cannot accept any Tab on which the Code is not readable.
During the Promotional campaign, the Participant is obliged to upload after logging into the Profile on the Website:
(i) the Code on the Tab, which is located inside the Tab and consists of ten (10) characters.
During the Promotional campaign, the Participant must upload the above, in the interface accessible by clicking on the "Upload Code" button on the Website indicated in Section 2.1.2, in accordance with the instructions provided therein and these Terms and conditions. The Organiser reserves the right to determine whether the Code upload is correct based solely on the Organiser's own decision, which may not be challenged by the Participants, and the Participants shall not be entitled to claim any rights whatsoever in relation to the Organiser's decision.
The Participant can participate in the Promotional campaign if he/she uploads at least one (1) valid Code. Codes uploaded outside the duration of the Promotional campaign will not be considered. Participants acknowledge that the date of receipt of Code uploads is the date registered in the Organiser's processing system.
4.1. Daily Prizes:
- Fifteen (15) Mokobora Backpacks per day. – total 840
- Fifteen (15) pair of customized white Puma sneakers per day (available in sizes 7, 8, 9, and 10, subject to stock availability). – total 840
4.2. Weekly Prizes:
- Every week, three (3) lucky winners will receive an iPhone 16.
- Every week, five (5) lucky winners will receive a Samsonite trolley bag.
- Every week, 1,111 lucky winners will win Stylish 1.2 ltr cool cups
- Throughout the campaign, few selected lucky winners will get an exclusive opportunity for a meet and greet with Michele Morrone in Mumbai.
4.3. Grand Prize:
- One (1) Luxury car
- Winners of the iPhone 16 and Luxury Car must bear the applicable gift tax at the time of claiming their prize.
4.6. The Daily Prizes, the Weekly Prizes and the Grand Prize (hereinafter collectively referred to as the "Prizes") are non-transferable and, unless otherwise provided for in these Terms and conditions, are not redeemable for cash.
4.7 The Promoter excludes its liability for any defects or deficiencies in the Prizes and shall not be liable for any warranty or guarantee in respect of the Prizes, unless the exclusion of liability is expressly prohibited by Indian law.
The Organiser shall not be liable if the Tab gets lost or is damaged in the meantime, and therefore the Participant is not entitled to win the Prize. Nor shall the Organiser be liable if the authenticity of the Code cannot be established from the photograph sent by the Participant.

5. Winner Selection and Prize Claim Process
5.1. Winners for daily prizes will be selected via a randomized draw system on next day at 10.00 AM IST and the results will be announced at 11.00 AM IST on the official website www.winwithhell.in.
5.2. Winners for weekly prizes will be selected via a randomized draw system on every Monday at 10.00 AM IST and the results will be announced at 11.00 AM IST on the official website www.winwithhell.in.
5.2. Winners will receive a unique OTP via SMS and email, which must be entered on the website to claim their prize.
5.3. The Organiser reserves the right to verify the authenticity of the uploaded unique code, as well as other relevant details, before confirming the winner.
5.4. Prizes must be claimed within 10 days of the winner announcement. If a winner fails to claim their prize within this period, their entitlement to the prize will be forfeited.
5.5. The iPhone 16 will not be dispatched until the winner provides a challan copy as proof of tax payment.
5.6. Once a participant has won a prize with one unique code, the same unique code will only be eligible to participate in the Grand Prize (Luxury car) draw.
5.7. This Promotional Campaign is not valid for participants residing in the state of Tamil Nadu and Puducherry.

6. Additional Terms and Conditions
6.1. Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash. Participants cannot request a change of prize under any circumstances.
6.2. The Organiser reserves the right to modify, suspend, or terminate the Promotional Campaign at any time without prior notice.
6.3. The Organiser reserves the right to disqualify any participant who provides incorrect details, engages in fraudulent activity, or attempts to manipulate the campaign in any manner.

7. Publicity and Data Protection
7.1. By participating in this campaign, participants expressly consent to the use of their name, image, and participation details in marketing and promotional activities related to this campaign.
7.2. All personal data collected will be processed in accordance with the Organiser's Privacy Policy, available at www.winwithhell.in. Third-party service providers may be involved in managing data for campaign-related operations.

8. Governing Law and Liability
8.1. This Promotional Campaign is governed by Indian law, and any disputes arising from participation shall be subject to the exclusive jurisdiction of the courts in Mumbai.
8.2. The Organiser and Operator are not liable for:
- Technical failures, errors, or incorrect entries.
- Any loss of prize due to incorrect personal details provided by the participant.
- Any circumstances beyond their reasonable control that may affect prize delivery.
8.3. Participants agree to indemnify the Organiser against any claims related to their participation.

These Terms & Conditions ensure transparency and fairness while maintaining a professional and legally sound framework for the Promotional Campaign. Participants are encouraged to read them thoroughly before participating.

9. Miscellaneous provisions
9.1 Neither the Organiser nor the Operator accepts any liability for any defects/errors in the Code upload (e.g. misspelling of the code, etc.), for any failure or delay in the delivery of the Prize, or for any damage caused during the delivery of the Prize, which is beyond the control of the Organiser or the Operator.9.2 The Organiser and the Operator exclude all liability for any external attacks on the www.winwithhell.hu website and the server that operates it, for the so-called SQL attacks. Thus, in the event that, as a result of an attack on the Website or the server, the Participants receive incorrect system messages regarding their prizes, winner/non-winner status, etc., the Organiser and the Operator shall not be liable in any way for such cases.
9.3 The Promoter reserves the right to exclude any Participant from the Promotional campaign with immediate effect if it detects or has reasonable grounds to suspect any (computer) manipulation or any conduct incompatible with or in any way offensive to the spirit of the Promotional campaign.
9.4 If the Participant closes the browser window while uploading the Code or if the connection (for any reason) to the server's website is lost, the Organizer or the Operator shall not be liable for any loss of data.
9.5 The Organiser and the Operator exclude any liability for any failure of the Website for reasons beyond their control, during which time the Website may be unavailable or of limited use, but will take all necessary steps to investigate and rectify the cause of the failure as soon as possible.
9.6 The Organiser reserves the right to modify the terms and conditions of the Terms and Conditions without giving any reason, including the termination of the Promotional campaign. The Organiser will publish this relevant information with the same publicity as other announcements in the Promotional campaign. After the modification, the Participants may fully exercise their rights acquired up to the date of the modification. Before participating in the Promotional campaign, please read these Terms and Conditions carefully, in particular any amendments, so that you are always aware of the terms and conditions of the Terms and Conditions. Participation in the Promotional campaign is voluntary. The limitations and exclusions of liability in relation to the Promotional campaign shall apply to the extent permitted by applicable law.
9.7 The Organiser shall not be held liable for any misadvertisement of the Promotional campaign if it is made without its consent, beyond its control.
9.8 These Rules shall be governed by Indian law and any disputes arising in connection with participation in the Promotional campaign shall be subject to the exclusive jurisdiction of the Indian courts.
9.9 If any provision of these Terms and Conditions is invalid, illegal or unenforceable under Indian law, all other provisions of these Terms and Conditions shall remain in full force and effect and the invalid, illegal or unenforceable provision of these Terms and Conditions (as long as it remains invalid, illegal or unenforceable) shall be severed from these Terms and Conditions. The Participant and the Organiser shall use all reasonable efforts to replace the provision that is deemed invalid, illegal or unenforceable (severed) with a valid, legal and enforceable provision that has the legal effect of the intended legal effect of the severed provision to the maximum extent possible.
